What's the legal alcohol limit for an undercover officer on duty involved in a traffic fatality?

What's the legal alcohol limit for an undercover officer on duty involved in a traffic fatality? Here in Houston, an undercover officer on duty lost his life in a traffic accident without wearing a seatbelt and more than 3 times the legal limit for alcohol...and that test came much later through autopsy. And the the driver of the truck he hit was an undocumented foreign national (Mexican) who was jailed immediately and charged with negligent homicide.
The police are saying that drinking and driving is O.K. for them, no matter how much alcohol, as long as it didn't contribute to the accident!
